The Committee on Energy and Public Works moved to amend the committee substitute bill on page 3, section 3, on line 46, after the word “storage” and before the comma and the word “or” by inserting the words “field activities”;

On page 10, section 5, beginning on line 12, by deleting subdivision (3) in its entirety and inserting in lieu thereof the following new subdivision (3) to read:

“(3) Criteria for the design, operation, maintenance, or methods of leak detection. Acceptable leak detection shall include, but not be limited to, visual inspections, an inventory control system together with tank testing, or a comparable system or method designed to identify leaks from aboveground storage tanks: Provided, That the secretary may not require any regulated tanks to be lifted, moved, or otherwise physically altered in connection with a visual leak detection program in the absence of a confirmed release: Provided, however, That in addition, the secretary shall allow the use of remote non-destructive examination technologies in connection with any required periodic physical inspections of tanks in order to reduce, to the extent possible, human entry to confined spaces;”;

On page 10, section 5, on line 23, after the word “recordkeeping” and before the semicolon, by inserting the words: “which will include at least one geo-located and time-stamped photograph taken of the tank during routine inspections and kept for a minimum of 12 continuous months;”;

AND,

On page 12, section 6, beginning on line 19, by striking the new subsection (e) in its entirety.
